written modification
Definition
A written modification is a formal, documented change to an existing contract that both parties sign to update the original agreement. Unlike a verbal conversation where you and the other party agree to change something, a written modification creates a physical record that the new terms are official and legally binding.
Example
If your lease originally required you to pay rent on the 1st of each month but your landlord agrees to accept payment on the 15th instead, a written modification would document that change so neither party can later claim the agreement never happened.
Watch Out
Many contracts include a clause requiring that any changes be made through a written modification, which means a handshake deal or email exchange might not legally count as a valid update to your contract.
