written consent

Definition

Written consent is a signed document where someone formally agrees to allow something to happen. Unlike a verbal agreement, written consent creates a physical record proving that a person gave their approval before an action was taken.

Example

Before a photographer uses photos of your customers in your marketing materials, you would need each customer to sign a written consent form giving you permission to use their image. This protects you if anyone later claims they never agreed to appear in your ads.

Watch Out

A verbal "yes" or an email agreement may not qualify as written consent in all legal situations, so always check your contracts to see exactly what form of consent is required.
