Definition

When you pay someone to create something for your business, like a logo, website, or written content, the law determines who actually owns the copyright to that work. In most cases where an employee creates something as part of their job, the business automatically owns it, but the rules get trickier when you hire freelancers or independent contractors.

Example

You hire a freelance graphic designer to create your company logo, but without a written contract specifically saying it is a work made for hire, that designer legally owns the copyright and could prevent you from using it however you want.

Watch Out

Always get a signed written contract with any freelancer or contractor that explicitly states the work is made for hire, because a handshake deal or simple invoice will not protect your ownership of the creative work you paid for.
