similar services

Definition

Similar services refers to offerings that are alike enough in nature, purpose, or target customers that they could reasonably compete with each other in the marketplace. Courts and contracts use this phrase to define boundaries around what a business or person can and cannot do, especially in non-compete agreements or trademark disputes. The idea is that two services do not need to be identical to be considered similar, just close enough that a reasonable customer might confuse them or choose one over the other.

Example

If you sign a non-compete agreement promising not to offer similar services to your former employer, a court might decide that opening a bookkeeping firm counts as a similar service to the accounting firm you just left.

Watch Out

This phrase is intentionally vague, so always push to get specific examples written into any contract that uses it so you know exactly what you are and are not allowed to do.
