Definition

Return of property is a legal demand or court order requiring someone to give back physical items that belong to another person or business. This can happen after a dispute, a search by law enforcement, or the end of a contract where one party held onto goods, equipment, or documents belonging to someone else.

Example

If the police seized your business computers during an investigation and later determined they were not relevant to the case, you could file a motion for return of property to get them back.

Watch Out

If you lent equipment or property to a contractor or tenant and they refuse to return it, you may need a court order to get it back rather than simply taking it yourself, since self-help repossession can sometimes get you into legal trouble.
