post-employment obligation

Definition

A post-employment obligation is a legal duty that a former employee must continue to follow even after they leave your company. These obligations are typically spelled out in an employment contract and can restrict things like where the employee can work next, who they can contact, or what information they can share.

Example

You hire a sales manager who signs an agreement promising not to contact your clients for one year after leaving, and that promise is a post-employment obligation she must honor even on her last day.

Watch Out

Courts in some states will throw out overly broad post-employment obligations, so you need a lawyer to make sure yours will actually hold up if you ever need to enforce them.
