Definition
A pending patent is an invention that someone has applied to protect with the government but has not yet received official approval. During this waiting period, which can last anywhere from one to three years, the inventor has some protection and can legally label their product 'patent pending' to warn others that protection may be coming.
Example
If you invent a new type of coffee lid and file your paperwork with the patent office, your invention is considered patent pending while the government reviews your application and decides whether to grant you exclusive rights.
Watch Out
Copying a product marked 'patent pending' is risky because if the patent gets approved, the patent holder can sue you for damages going all the way back to when you first started copying it.
