Definition

Nonuse means you have stopped using a trademark, business name, or legal right for an extended period of time, which can cause you to lose that right entirely. Courts and trademark offices treat long periods of nonuse as a sign that you have abandoned whatever legal protection you had.

Example

If you registered a trademark for your bakery but closed the shop and stopped using the logo for three or more years, a competitor could argue you abandoned it and successfully register the same mark for themselves.

Watch Out

Even if you plan to revive a brand or business later, failing to document a legitimate reason for the gap in use can cost you the legal rights you worked hard to establish.
