non-conforming

Definition

Non-conforming means that something does not meet the agreed-upon requirements or specifications in a contract. When a product, service, or piece of work is called non-conforming, it means the seller or contractor delivered something different from what was promised.

Example

You order 500 blue t-shirts for your store and the supplier ships 500 red ones instead, making that delivery non-conforming under your purchase agreement.

Watch Out

If you accept and pay for non-conforming goods without formally objecting in writing, you may lose your legal right to demand a refund or replacement later.
