Definition
An express written agreement is a contract where both parties have clearly spelled out all the terms and conditions in a physical or digital document that everyone has signed. Unlike a verbal agreement or an implied understanding, this type of contract leaves little room for debate because the rules, prices, deadlines, and responsibilities are all stated explicitly in black and white.
Example
If you hire a web designer and you both sign a document stating the project costs $3,000, will be completed by March 1st, and includes three rounds of revisions, that signed document is your express written agreement.
Watch Out
A handshake deal or even a detailed email exchange may not qualify as an express written agreement, so always get important business arrangements into a signed document to protect yourself.
