Definition

An electronic signature is any digital method you use to show that you agree to or approve a document, whether that's typing your name, clicking an 'I agree' button, or using a service like DocuSign to sign with your finger or mouse. Courts and businesses treat a valid electronic signature the same way they treat a handwritten signature on paper. The law that makes this possible is called the E-SIGN Act, and it applies across the United States.

Example

When a new client fills out your service agreement online and types their name into a signature box at the bottom, that counts as a legally binding electronic signature just as if they had signed a printed contract with a pen.

Watch Out

Some documents, like wills, certain real estate transfers, and court papers, still require old-fashioned ink signatures, so always check the rules for your specific document type before assuming an electronic signature will hold up.
