Definition

A defense is the legal argument or set of reasons a person or business uses to fight back against a claim or accusation made against them. Think of it as your official explanation for why the other side is wrong, or why you should not be held responsible even if the basic facts of their claim are true.

Example

If a customer sues your business for a slip and fall, your defense might be that the customer was texting and not watching where they were walking, making them responsible for their own injury.

Watch Out

Having a defense does not automatically protect you because you still need to raise it properly and at the right time, which is exactly why getting a lawyer involved early matters.
