Definition

Cumulative remedies means that when someone breaks a contract or violates your rights, you can pursue multiple legal options at the same time rather than being forced to pick just one. A contract clause establishing cumulative remedies tells everyone involved that using one remedy does not cancel out your right to use another remedy on top of it. Think of it as having several tools in your toolbox that you can use together, not just one.

Example

If a client refuses to pay you, a cumulative remedies clause lets you charge them late fees, sue for the unpaid balance, and seek your attorney fees all at once rather than choosing only one of those options.

Watch Out

Without this clause in your contracts, a court might decide that choosing one remedy means you gave up your right to pursue the others, so make sure your attorney includes this language in any agreement you sign.
