Definition
This phrase refers to a court that has the legal authority to hear and decide a particular type of case. Not every court can handle every kind of dispute, so the law requires that cases go to the court that actually has the power to rule on that specific matter. For example, a small claims court can handle minor money disputes but cannot handle a federal trademark case.
Example
If your contract says disputes must be resolved in a court of competent jurisdiction, it means the case has to be filed in whichever court legally has the right to handle that type of claim, such as a state court for a breach of contract dispute under a certain dollar amount.
Watch Out
When you sign contracts with this phrase, make sure you understand which specific court would actually handle your dispute, because fighting a case in the wrong court wastes time and money and can get your case thrown out entirely.
