Definition
Burden of proof refers to who is responsible for proving their side of a legal dispute and how convincingly they must prove it. In most civil cases (like contract disputes or lawsuits against your business), the person making the claim must show that their version of events is more likely true than not, which courts often describe as being more than 50% convincing.
Example
If a customer sues your business claiming you breached a contract, that customer carries the burden of proof and must bring enough evidence to convince a judge or jury that you actually broke the agreement.
Watch Out
The burden of proof can sometimes shift to you as a business owner if you raise certain defenses, so never assume the other side has to do all the work in court.
